Cuando los medios de difusión dieron la noticia sobre la nueva ley del Estatus Personal Chiíta en Afganistán, muchos se horrorizaron por el hecho de que esa norma legaliza la violación dentro del matrimonio. La violación marital ha sido legalizada, exclamaron los titulares de prensa, y todos reaccionamos conmocionados y disgustados. Más aún, luego de una lectura atenta de esa ley, se descubre que en realidad es mucho peor de lo que pensamos inicialmente, escribe Emma Bonino, Vicepresidenta del Senado italiano.

El más grave problema con esta ley no está constituido sólo por las disposiciones sobre la violación marital, ya más que aborrecibles de por sí, sino sobre todo porque oficialmente relega a las mujeres a la condición de ciudadanos de segunda clase. Esta norma legitima restricciones sobre cualquier cosa que las mujeres hagan, incluyendo a donde van y a quien visitan, legaliza su subyugación a los antojos de otros y les niega la facultad de decidir sobre sus hijos y el acceso a la educación y al cuidado de la salud.

A pesar de los anuncios de que esa ley será revisada, no debemos bajar la guardia. En efecto, las noticias provenientes de Kabul acerca de que la ley será reconsiderada no son suficientemente positivas. Es hora de mantener nuestro repudio y perseverancia, de respaldar los llamados internacionales para la derogación de esa ley, de que todos expresen públicamente su rechazo a sus propios gobiernos y a las autoridades afganas, y de emprender acciones innovadores y no violentas para que tal afrenta a las mujeres se derogue.

We would like to thank you once again for signing the Appeal calling for the withdrawal of the Shia Personal Status law, which entrenches severe restrictions on women’s freedom of movement and gives an aura of legitimacy to multiple forms of discrimination against women.
We have the pleasure to inform you that the Appeal, which was signed by more than 1000 parliamentarians, representatives of government and international organisations, civil society activists and citizens of 37 countries, will be formally delivered by a delegation of its sponsors to the Afghan embassy in Belgium, on Thursday 30 April 2009.

The delegation will be composed of Emma Bonino, Vice-President of the Italian Senate, Niccolò Figa-Talamanca, Secretary General of No Peace Without Justice, Nathalie Gilson, Member of the Parliament of the Brussels-Capital Region, and Catherine Absalom, representative of the International Federation for Human Rights (FIDH).

Despite assurances by Afghan President Hamid Karzai that the law will be revised, it is still not the time for complacency. Afghan women demonstrating in Kabul against the new bill were brutally attacked and regional parliamentarian Sitara Achikzai was recently assassinated, joining the growing list of activists fighting for the emancipation of women in Afghanistan who have been victimized: these developments are anything but reassuring. The international community must maintain its vigilance and make clear to Afghan authorities that the human rights of Afghan women will not be sacrificed for the sake of diplomatic appeasement.
